The States of Kansas and Missouri have very specific laws regarding agency relationships with regard to the sale and lease of commercial real estate.  Both states allow the agent to represent the either the Seller/Landlord or the Buyer/Tenant.  But this relationship must be clearly determined and defined by either a Sale/Lease listing or a Buyer/Tenant representation agreement.  These documents establish an agency relationship that clearly defines the duties and obligations of the parties. 

It further establishes the commission amount and who is responsible to pay the commission.  If a listing or representation agreement is not signed then the agent and his broker must act as a Transaction Agent.  A Transaction Agent does not represent either the Seller/Landlord or the Buyer/Tenant.  He must treat each party equally and can not provide guidance other than factual information. In most cases this is not to the advantage of the client whether Seller/Landlord or Buyer/Tenant.

As a result Beckner & Associates, Inc. asks each Buyer/Tenant we work with to sign an Exclusive Agency Agreement so we can represent their interest most fully. Unlike most companies, Beckner & Associates, Inc does not require the Buyer/Tenant to agree to pay our company a commission.  Instead the provision of our agency agreement simply requires the Buyer/Tenant to not enter into a Sale/Lease until either the Seller/Landlord or Buyer/Tenant has agreed to pay Beckner & Associates, Inc. an agreed commission amount. If we are to represent a Seller/Landlord, we require an Exclusive Listing Agreement be signed.  This document clearly states the terms of the listing and the responsibilities of each party.  Many owners believe brokers will market their properties without an exclusive listing.  This is incorrect.  Without a listing the broker has no guarantee that he will be paid for his services.  Therefore, brokers concentrate on the properties they have listed.  Click here for our Exclusive Seller/Landlord Agency Agreement form.
